Court reserves ruling on Kano LG allocation

A Kano State High Court has reserved its ruling in a case filed by the National Union of Local Government Employees (NULGE) against the Central Bank of Nigeria (CBN), the Attorney General of the Federation (AGF), and other parties over the withholding of Kano State’s local government allocations.

 

The applicants, led by NULGE Chairman Ibrahim Muhd, alongside Ibrahim Uba Shehu, Ibrahim Shehu Abubakar, Usman Isa, Sarki Alhaji Kurawa, and Malam Usman Imam, sought the court’s intervention to ensure the disbursement of funds critical to local governance in the state.

 

Earlier, on November 6, the court issued a restraining order preventing the CBN, AGF, and other respondents from withholding allocations meant for Kano’s 44 local governments. The applicants, represented by counsel Bashir Yusuf Muhammad, had filed an ex parte motion dated November 1, requesting the court to prevent any delays in the release of these funds.

 

During Wednesday’s hearing, Muhammad filed a reply to the respondents’ notice of preliminary objection, arguing for the court to dismiss their counter-affidavits and grant relief to the applicants. He emphasized the importance of safeguarding the local governments’ financial entitlements.

 

Counsel for the 44 local governments, Mr. Eyitayo Fatogun (SAN), supported the plaintiffs’ application, noting that the disbursement of local government allocations should proceed unhindered.

 

However, representatives for some respondents sought to challenge their inclusion in the suit. CBN counsel Ganiyu Ajape argued that the court lacked jurisdiction over the matter and requested the removal of the CBN from the case. Similarly, GTBank counsel Faruk Asekome contended that the bank had no role in the disbursement of allocations and requested the dismissal of the case against his client, along with costs.

 

Justice Ibrahim Musa Muhammad adjourned the case to a date that will be communicated to the parties, leaving both the preliminary objections and the substantive matter unresolved for now.
